Cape High Court Rules Dagga is Legal Our team at Medical Cannabis Oil is very excited about the recent legal development in which the Western Cape High Court, made a landmark ruling in which they declared that its an infringement of a persons right to ban the use of dagga and its derivatives being used by adults in the privacy of their own homes. The recent ruling of the High Court, now allows for the possession, cultivation and use of cannabis at home for private use. The court also ruled that Parliament has 24 months to make certain changes to sections of the Drug Trafficking Act as well as the Medicines Control Act.   The successful application to decriminalise cannabis was driven by Dagga Party leader Jeremy Acton and Rastafarian Garreth Prince who argued on December 13 and 14 last year for the decriminalisation of the herb. Acton, Prince, and 18 plaintiffs applied to the court for the Criminal Prohibition of Dagga Act (sections 4b and 5c), read with certain sections of Part III of Schedule 2 of the Drugs and Drug Trafficking Act, to be declared unconstitutional. Cape Town High Court Judgement on Use of Cannabis In Private Homes Some very exciting developments have taken place recently within South Africa, specifically related to the use of cannabis products. On the 31st of March 2017, the Western Cape High Court ruled that national legislature has 24 months to within which to change certain sections of the Drug Trafficking Act and the Medicines Control act, to allow for the legal use of cannabis and its derivatives within the privacy of your own home. The South African Parliament is in the process of getting a copy of the judgement and will then study the contents there in. There is still a process to go, firstly if the two laws are found to be unconstitutional. Then the Constitutional Court will still need to confirm this judgement and only then can Parliament act, there is also a chance that the state will appeal the matter. When all the litigation is completed, then the Constitutional Court must confirm the judgement and then Parliament is then required to fix the issues that have been found to be unconstitutional.
